Question:
1. What are
the requirements to file for a divorce?
Answer:
One of the parties must have lived in Arizona for at least 90 days prior to
filing a Petition for Dissolution of Marriage (divorce) and you must state that
the marriage is irretrievably broken.
Question:
2. What is a Qualified Domestic Relations Order (QDRO)?
Answer:
A QDRO is a court order which directs a plan administrator to divide a
"qualified" retirement plan in a divorce. Qualified plans include most
retirement plans and programs that are authorized by federal law, including
401K, 403Bs, pensions, IRAs, deferred compensation plans and others. Federal law
requires that a QDRO be prepared and approved by the Court for the division and
distribution of assets in qualified plans. Because retirement plans are often
the single largest asset that a couple holds, the QDRO is very important to the
distribution of assets in a divorce.
Question:
3. I know who the father of my child is, but he won't pay child support. Can I
force him to pay child support?
Answer:
Yes. Once you have an order of paternity, the father will be ordered by the
court to pay child support. You can get an Order of Paternity either by having
the father sign an acknowledgement that he is the father or by getting the court
to order blood tests. Once the paternity order is signed by the court, you can
seek child support from the father.
